These Terms & Conditions ("Terms") govern your use of Magikast and any purchases made through the website.

Magikast is operated by Baby Design Ltd., a company registered in the United Kingdom, with a trading address at 378 Mare Street, London E8 1HR, UK.

By accessing Magikast, creating an account, or placing an order, you agree to be bound by these Terms.

1. About Magikast

Magikast provides personalised children's storybooks created on demand based on information provided by customers. All purchases are made by adults. Children do not create accounts or enter into contracts.

2. Accounts and Eligibility

• You must be at least 18 years old to create an account or place an order.
• You are responsible for ensuring that all information you provide is accurate and up to date.
• We reserve the right to suspend or terminate accounts that breach these Terms.

3. Ordering Process

• Customers may build and preview their personalised storybook before checkout.
• Edits to characters and stories are permitted only before checkout.
• An order is considered final once checkout is completed. After payment, no further changes can be made to the story, character, or artwork.
• All stories and books are generated on demand.

4. Preview Availability

Full previews of personalised books are currently available. We reserve the right to limit or modify preview functionality in the future.

5. Pricing and Payment

• Prices are displayed in GBP or EUR and are inclusive of VAT, where applicable.
• We reserve the right to change prices at any time, but price changes will not affect completed checkouts.
• In the event of a pricing error caused by a technical bug or mistake, we reserve the right to cancel affected orders and issue a full refund.
• Payments are processed securely via third-party payment providers.

6. Personalised Products and Refunds

All Magikast books are made to order and personalised.

For this reason, all purchases are non-refundable once payment has been made, as content generation and production begin immediately and incur costs.

We do not offer cancellations or refunds for personalised products except where required by law. In certain circumstances, such as a damaged or defective book, we may offer a replacement at our discretion. Customers should contact us via email or live chat to report issues.

7. Printing, Delivery, and Shipping

• Printed books are fulfilled in-house and shipped to the UK and EU.
• Estimated delivery time is 5–9 working days. Delivery times are estimates and not guaranteed.
• If a book is delayed or arrives damaged, Magikast will take responsibility and work with the customer to resolve the issue.
• If an incorrect delivery address is provided, the customer must contact us as soon as possible. We cannot guarantee changes once an order is in production or shipped.

8. Intellectual Property

• Upon purchase, the customer owns the personalised story text and illustrations created for their order.
• Magikast retains all underlying platform, technology, and system rights.
• Customers are granted a personal, non-commercial licence to use their story and book.
• Magikast reserves the right to use generated stories and illustrations for marketing, promotional, portfolio, and product improvement purposes, unless otherwise agreed.

9. Acceptable Use

• You agree not to submit content that is unlawful, offensive, harmful, or inappropriate.
• We reserve the right to refuse, suspend, or cancel any order that violates these Terms or is deemed inappropriate.

10. Service Availability

• We aim to keep Magikast available at all times but do not guarantee uninterrupted access.
• We are not responsible for downtime, delays, bugs, or errors caused by technical issues beyond our reasonable control.

11. Disclaimer

• Magikast stories are provided for entertainment purposes only.
• We do not guarantee educational outcomes, behavioural changes, or specific developmental benefits.

12. Limitation of Liability

• To the fullest extent permitted by law, Magikast and Baby Design Ltd. shall not be liable for any indirect, incidental, or consequential losses.
• Our total liability for any claim shall not exceed the amount paid for the relevant order.
• Nothing in these Terms limits liability where it cannot be excluded by law.

13. Termination

• We reserve the right to suspend or terminate access to Magikast where these Terms are breached.
• Users may delete their accounts at any time.

14. Complaints and Disputes

If you have a concern or complaint, we encourage you to contact us first so we can resolve the matter informally.

These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of its courts.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the website with a revised date.

Continued use of Magikast constitutes acceptance of the updated Terms.
